Confidentiality

Information discussed during mediation sessions is confidential with the exception of mandated reporting as required by the state of Illinois. Confidentiality and mandated reporting are explained in the Agreement to Mediate document that is signed by each party at the beginning of the first mediation session.

Who can benefit from mediation?

Anyone involved in a dispute can benefit from participating in mediation services. Although some parties find a need to involve attorneys in their disputes, others prefer to resolve issues without the complications and costs of litigation.

Is mediation voluntary?

Although some parties are court ordered to participate in mediation, many choose mediation voluntarily. Anyone can participate in mediation with or without being mandated by the courts.

When can parties expect to reach a mutually agreeable resolution?

Because there is no limit to the number of mediation sessions in which parties may participate, the outcome of reaching a mutually agreeable resolution varies. Some are able to find a resolution within the first session while others may return to mediation numerous times before reaching an agreement.

Who can participate in mediation?

Generally, mediation involves two participants who are involved in a relational or civil dispute who wish to avoid litigation. However, including additional parties may assist in the mediation process and their level of participation will be determined by the mediator on a case-by-case basis.

How long is a mediation session?

The first mediation session is scheduled for up to two hours. Additional mediation sessions are scheduled for up to one hour. There is no limit to the amount of allowable scheduled sessions.

Is mediation the same as negotiation?

While the terms are sometimes used interchangeably, mediation is not the same as negotiation. Negotiation may occur during mediation, but the “give and take” commonly associated with negation falls second to discovering the needs of each mediation participant. Mediation requires that parties’ viewpoints are considered with the goal of reaching an agreement.
